To be able to develop this Chapter it took the effort of several persons, a collection of many Wills and a number of messages. It would be unjust to you the reader to understand all of this by putting down the end results. (RLV)
In a message to Lynda Veal and myself from Frederick V. Saunders on September 12, 1998 8:18 PM. Rick writes:
That brings to the birth of Eleanor, the Ancestry File, the 1848 birth year that Bob has listed has to be WAY off. From the Court Records we know that she married WILLIAM SMOOT (between 1896-98) suggesting a date of birth circa 1687. This would be consistent with having a son JOHN SMOOT, and having children by her 2nd husband WILLIAM RIGG, probably in the 1710’s. (NOTE) The 1848 birth inconsistence came from a letter indicating Elinor Veale was 51 years old at the date of her father, MORRIS I’S Will of 1695. This was a total error, as she is in the Will of 1695 and not in the Will of Morris II in 1750. From the 1737, Will of her brother, WILLIAM VEALE clears up the error of spelling her 2nd husband as WILLIAM RIGG, not TRIGGS or RIGGS. (RLV)
This brings us to the children of William Smoot. In his Will he, William named: 1. Sarah, 2. Winifred, 3, Winifred, 4. William, and 5. Thomas. That Eleanor Deeded land to her son John Smoot, shows that he was born post-humorous in 1707. The question is, which children are by his first wife, Ann, and which are by Eleanor Veale. The source of William Smoot’s identity is from: “The Smoot of Maryland & Virginia”, by Harry Wright Newman. He speculated that the daughters obtained their majority and were all children by the first marriage, and the sons came from the second. I suspect this source of information Lynda sent on September 06, 1998 on Smoot showing as above three daughters on the first marriage and the sons by the second.
There is some evidence that Newman may have not been correct in his assumption that the daughters were of the first marriage and the sons of the second. Based on who Eleanor mentioned in her Will, it would appear that more than likely William and Thomas were children by Ann. Eleanor made no mention of ether William or Thomas or any of her children in her Will.
Next is the Court Record of 1717 where Mary Smoot, daughter of William asked for John Veal to be her guardian. That she chose a guardian shows that she was over 14 but not 21. The earliest Mary could have been born is 1696, about the time Eleanor married William Smoot, and that Mary chose a Veale as guardian, I believe she was a daughter by Eleanor. She definitely was not of age when William Smoot wrote his Will in 1706 as Newman speculated. Note: The John Veal listed above would more than likely be John Veale I, Eleanor’s brother. I would be lead to believe that even though John Veal I’S Will was proved in 1718, that his son John II would not be of age to act as guardian, he too was listed as being under 14 years of age on this date. Now to the Will of William Veale of St. Mary’s County, Maryland I believe he is closely related to Eleanor (Veale) Smoot, Rigg & Austin for the following reasons: I notice that no further information on what I received referencing William Veale, son of Morris I & Dorothy. Could this be William of St. Mary’s County, Maryland? Yes, this Will only lists the children of Eleanor Veale and none of his own. (RLV)
Compare the Wills of: 1). Eleanor’s 3rd husband John Austin, 2), her own Will, and 3). The Will of William Veale.
John Austin named grandson William Harrison the son of William Harrison. He also mentioned Winifred Harrison, relationship unknown. It would appear the Winifred Smoot, married William Harrison. William Veale’s will name: William Harrison the son of William Harrison. The Will of Eleanor named grand children Thomas Rigg and William Veale Rigg are likely the same person. The original Will needs to be examined.
NOTE #1: To clear up a point at this time: William Veale, 1737, Maryland Calendar of Wills, #9, page 235, as found by Ralph C. Veale. “I give and bequeath unto my Dear and Loving wife, Margaret Veale my whole and sole Estate by he (two words missing) and Enjoy during her life, and when it shall please God to take her, my will is the same Estate shall be equally divided between William Harrison, son of William Harrison and William Veale, son of Morris Veale (?). And if it pleases God to take either of these boys should die before receiving their portions, this portion will be equally divided by William Veale Rigg, the son of James Rigg. (RLV)
NOTE #2: To further explain some of the misleading information above: William Veale of the 1737 Will and the son of Morris Veale and Dorothy did not write himself into this Will. The William Veale named above in the 1737 will would be the son of his brother, Morris Veale II and Sarah of the 1750 Prince William County, Virginia Will. This William Veale did marry Lydia Turley and is included in the 1750 Will of Morris II. (RLV)
Why should William Veale of St. Mary’s County, Maryland leave his property to William Harrison, grandson of Eleanor (Veale) and William Veale, son of Morris Veale? A third person if either of them should die was William Veale Rigg, also a grandson of Eleanor. If this is true, it would appear that William son of Morris could be a grandson of William (the writer of the 1737 Will) brother John, named Morris. I would think that William Veale and Margaret Veale had no surviving children, and therefore left his land to a grandson of his brother JOHN, and if one of them died then to another grandson of his sister Eleanor.
NOTE: To expand the Family Group even further: I’m the first to agree that the 1737 Will of William Veale is the brother of Eleanor Veale, both being children of Morris & Dorothy Veale. Now let us talk about the brother JOHN listed above: John Veale I married Deliverance Taylor and they too had a child named, Morris Veale. In John Veale I’s Will of 1718, a Morris was also named, however, this Morris Veale had deceased prior to 1739 about the 1737 time frame. (RLV)
To go to other names mentioned in the Will of Eleanor (Veale) Austin. John Smoot is obviously the unborn child of Sarah Smoot, equal proportions with the rest of the grandchildren. This is John Smoot’s 2nd wife, as he had married her as he widow of Thomas Crane.
Grandchildren: Thomas Rigg, William Veale Rigg, Isabella Rigg, Winifred Rigg (children of Eleanor’s son -------- Rigg, by her 2nd husband William Rigg
Subella Rigg: (since not mentioned with the above grandchildren, is an unmarried daughter of Eleanor by her 2nd husband, or is she a stepchild?
Grandson: William Harrison son of William Harrison (Apparently William Harrison who married Winifred Smoot)
Asten Stanford Smoot (Grandson of Eleanor, son of John Smoot by her 1st marriage)

Sarah Rigg, Winifred Harrison, Susanna Doxley appears to be daughters, and “Cousin” Susanna Green. The first five appear they may be daughters and daughter-in-law. Sarah Rigg, a daughter-in-law, married to ------- Rigg, mother of the Rigg children? Winifred Harrison, the daughter of Winifred Smoot was married to William Harrison. Susanna Doxely, a daughter of Eleanor who married Thomas Doxley. Susanna apparently a daughter of William Rigg, since not named in William Smoot’s will. Sarah Smoot is a daughter-in-law to John Smoot, Sarah Rice, her daughter, Sarah Smoot?

Did you notice that Eleanor (VEALE) SMOOT, RIGG and Austin in her Will named a “cousin” Susanna GREEN. Cousin of course could have been a very broad meaning. Do you know who she is?
If Susan Green was a niece, I noticed that Eleanor’s brother, John has a Susan.
If she were an actual “Cousin” as we would think, it could be very important in identifying Morris Veale I’s wife, Dorothy surname as GREEN.
NOTE: You will notice that this same subject came up in he discussion of Susan Veale, the daughter of John Veale I & Deliverance Taylor. In my opinion, that if Dorothy were a Green as this may suggest, this would imply that Dorothy would have a father or brother with a surname of GREEN. In the make-up Census of Virginia, 1790 shows 69 listed GREEN Heads of Household. A William GREEN does show up in Fairfax County, Virginia with 4 white souls. This does leave us a slim probability, as Fairfax County was one of the divisions from Westmoreland County, Virginia (RLV)

Here is the information on Eleanor Veale. I haven’t had time to finish all the documents of where everything is yet. I descended from her son JOHN SMOOT that was born posthumously in 1707. It is uncertain which of William Smoot’s other children are by which wife, but at least a part of them are children of Eleanor. Since Mary Smoot in 1717 asked for John Veale to be her guardian, it would appear that she be a daughter of Eleanor
William Smoot, the son of Thomas and Jane (Batten) Smoot, was born during 1656 in Pickawaxon Hundred in Charles County, Maryland. On October 30, 1671, he the eldest son and heir of Thomas Smoot, deceased, of Charles County, received a warrant for 250 acres of land known as “Smoot’s Chance”. One hundred fifty acres had been retained in the name of Thomas Smoot. While the remaining 100 acres had been assigned by Robert Ellis, of St. Mary’s County, Maryland, who had the rights thereof by assignment from Robert Smith, due them for services performed in the Province. In November 1681, he received 140 pounds of tobacco for deeds of public service that is believed to be performed as a punitive expedition against the Indians.
In May 1683, William Smoot conveyed to his “brother” Thomas Smoot for 10,000 pounds of tobacco land formerly granted to John Goldsmith of St. Mary’s County, Maryland, lately deceased, lying on the west side of Wicomico River near the head of Smoot’s Branch. In October of the same year, he deeded to Humphrey Warren for 7,000 pounds of tobacco “The Hills” of 240 acres of the Wicomico except for that portion which was sold to Richard Smoot
On August 05, 1783 William Smoot and Annie his wife conveyed to William Newman for 8,000 of tobacco “Wicomico Fields Relations” which had been resurveyed by Captain Randolph Brandt, lying in Pickawagon Hundred, but which was then a portion of the tract of land granted to William Smoot by patent. On August 09, 1684 William Smoot and his wife Annie deeded to Captain Randolph Brandt a portion of “Wicomico Fields”. On August 12 of the same year, William Smoot sold to Samuel Luckett for 5,000 pounds of tobacco land adjoining “Johnson’s Choice” and adjacent lands lain out for George Goodrick
In April 1689 William Smoot sold another portion of “Wicomico Fields:, described as dwelling plantation to his kinsman Edward Smoot for 24,000 pounds of tobacco. The deed stated that it adjoined the land conveyed to William Newman and Captain Humphrey Warren. The conveyance was witnessed by: Randall BRYANT, Thomas GIBBONS and Elizabeth BUTLER
William Smoot in some manner sustained financial reverses, as evident by his numerous conveyances over a period of a few years, perhaps through the unsuccessful law suits emanating from his uncle’s estate, however, William Smoot, Gentleman petitioned the court to operate an inn. “Whereas your Petitioner described and for an honest extraction his parents (when in being) lived both in good repute and credit among the whole neighborhood and by their indulgent care left him a substance for his support and his outgoing enjoyment and for himself for some time since heir deceased lived in good rank and fashion. But since by frowns of fortune reduced to a mean condition, he being willing by ay lawful ways or means he may repair his fortune. Petitions to keep a house of entertainment to provide substance for his wife and children. The court granted him a license to maintain an inn paying a yearly fee of 1,200 pounds of tobacco
About this time the Northern Neck of Virginia offered opportunities to settlers, consequently having encountered unfortunate events in Maryland. William Smoot and his young family crossed over to Westmoreland County, Virginia and settled in Copley Parish at a date of 1695
Sometime after 1690 his wife Annie died, and he married secondly, between 1689 to 1700 to Eleanor Veale, daughter of Morris & Dorothy Veale, She was named Eleanor in her father’s will in 1695. In 1697/8 Thomas Wilson and Elinor Veale proved he will of Jemima Jadwin. On February 23, 1697/8, Mr. John Tanner was ordered to pay Elinor Veale 80 pounds of tobacco for her attendance of two days to prove the will of Jemima Jadwin. On June 26, 1700 it was ordered that Willoughby Allereton, Gentleman, Sheriff doe take Thomas Wilson and Ellendor Veale, now Ellendor Smoot, if they found his baylaywick, and them safely keep so that he have them their bodies at the next court to answer several information for perjury against them by John Tanner
On November 09, 1704 William Smoot, of Copley Parish, Westmoreland County, Virginia conveyed to Lawrence Pope of Washington Parish, same county, for 3,000 pounds of tobacco 100 acres of land lying partly in Copley and Washington Parishes, being part of tract granted to William Smoot by deed from Proprietor in August 1704, of escheated land from Alexander Gordon, deceased, of Westmoreland County. Eleanor Smoot waived her dower rights
The Will of William Smoot was dated April 23, 1706 and proved in Westmoreland County, Virginia on April 30, 1707 by John MOORE and John VEALE. He bequeathed two daughters, Sarah & Winifred, the dwelling plantation but Sarah was to have her portion on the river. In the event they died without heirs, the plantation was to revert to Mary. The later was to receive 3,000 pounds of tobacco and a feather bed at marriage
He devised to his wife Eleanor, all the land in Stafford County at Aquia to her and her heirs forever. His sons Tomas & William were willed certain personality, but his wife was to have “tuition” of his two sons until the age of 21 years.
Eleanor Smoot on December 05, 1717 deeded to her son John Smoot in the presence of Nathaniel Pope, Rebecca Bryant and John Elliott for natural love and affection certain goods and chattels at the age of 18 years. At a Court on January 29, 1717/18 the deed was recorded as made by Eleanor Smoot, now Rigg. John had been born 1707 posthumously
At the same time, Ellendor Rigg, relict of William Rigg departed this life without making any Will so far as she knows or believes and upon her motion certificate is granted for her to obtain letters of administration with John Veale was her security.
Also at this time, Mary Smoot, the daughter of William Smoot, asked that John Veal be her guardian.
Eleanor, as her third husband married JOHN AUSTIN, and moved to St. Mary’s County, Maryland
THE WILL OF JOHN AUSTIN
In the name of God, Amen, I John Austin of St. Mary’s County, Planter being very sick and weak in body but sound and prefect memory thanks be unto God for the same. I do make ad ordain this my Last Will and Testament in the manner following:
First I bequeath my soul into the hands of Almighty God and that gave it my body I recommend to the earth to be buried at the discretion of my executors here after named
(IMPRIMUS) I give and bequeath unto my Godson Austin Stanford Smoot three feather beds and furniture equivalent. Also seven cows, seven calves, thirty pounds of new pewter, three iron pots, one ten gallon pot, one three gallon pot, one 1 gallon pot, one young mare of three years old and her increase forever, and likewise one young horse of four years old and six killable hogs of four years old. Also I give to him the said Austin Stanford Smoot and his heirs forever.
(ITEM) I give and bequeath unto William Harrison, my grandson-in-law a certain parcel of land of the plantation which I now live on. Beginning at a large beech tree standing by a spring near the side of the creek running fro thence with a straight line into the woods to a large pine tree standing in the old field and from thence to the creek. And the said parcel of land to be the possession of William Harrison, the father of the above William Harrison to him and his heirs forever after the decease of my loving wife Ellenor Austin.
(ITEM) I give and bequeath unto my Godson Austin Stanford Smoote all the remainder of the land I now live on. To him and his heirs forever, and it is my will to the William Harrison to plant or cause to be planted two hundred young apple trees on my godson part to endeavor to defend any law suit on the account of the said land.
(ITEM) I give and bequeath unto my daughter Elizabeth Rigg one young black horse named to figure into my true intent and meaning that my beloved Ellinor Austin shall have the benefit of my estate that I now live bequeath during her natural life. Also it is my intent and meaning that if my godson the said Austin Stanford Smoot should depart this life without lawful issue. Then my desire is and my son-in-law John Smoot shall inherit the lands I have bequeathed to my godson Austin Stanford Smoot to him and his heirs forever
(ITEM) I give ad bequeath unto my godson Austin Stanford Smoot one small oval table and a cupboard also I give unto my godson Austin Stanford Smoot when he comes of age to receive twenty barrels of Indian Corn
(ITEM) I give and bequeath unto my two sons-in-law viz., John Smoot and William Harrison a certain tract of land lying in Stafford County containing 1,000 acres more or less adjoining Acquiah Creek in Virginia to them and their heirs forever
(ITEM) I do desire that if my beloved wife Ellenor Austin should depart this life before the said Austin Stanford Smoote attains the age of twenty-one years. Then it is my desire that my son-in-law John Smoot shall have his estate in possession until he arrives at the age of twenty-one excepting my Negroes
(ITEM) I give and bequeath unto my godson Austin Stanford Smoot my Negro woman Flora and her increase forever, Also a young Negro named William Tate which I give and bequeath to him and his heirs forever. Furthermore it is my will and desire that my godson Austin Stanford Smoot should depart this life without issues then the above Negroes and their increases I bequeath unto my grandson William Harrison and his heirs forever

Judgment is revived to Thomas Marson against William Rigg and his wife Ellenor for 797 pounds of tobacco and costs recovered by Thomas against Ellenor by the name of Ellinor Smoot. Page 267, October 01, 1713, Augustine Higgins brought suit in Ausust Court against John Veale for shooting a mare valued of 1,000 pounds of tobacco for damages of the plaintiff 2,000 pounds of tobacco. Giving evidence in this suit were William Smoot (this would be Eleanor’s step-son) and William Rigg (Eleanor’s 2nd husband)
